Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and EPIC ("EPIC," "we," "us," or "our") and govern your access to and use of our website, products, and services (the "Services"). By using the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to purchase from EPIC.

2. Account & Order Information

You agree to provide accurate, current, and complete information when placing an order. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Pricing, Taxes & Payment

  • All prices are in US dollars and may change at any time before you place an order.
  • Applicable sales tax is calculated at checkout based on your shipping address.
  • Payment is processed by our PCI-compliant processor (Stripe). You authorize us to charge your selected payment method for the total amount.
  • Promotional codes are limited to one per order, cannot be combined unless stated, and have no cash value.
  • We reserve the right to refuse or cancel orders for suspected fraud, pricing errors, or stock issues, and to issue a full refund in such cases.

4. Shipping & Risk of Loss

See our Shipping Policy. Title and risk of loss pass to you when the carrier accepts the package.

6. Limited Warranty

EPIC Trail is covered by a one (1) year limited warranty against defects in materials and workmanship under normal use. The warranty does not cover damage caused by accident, misuse, water exposure beyond the rated specification, unauthorized modification, or normal wear. To request warranty service, email support@epictrail.com with your order number and a description of the issue.

7. Disclaimer of Warranties

EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EPIC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.

9. User Conduct & Content

  • You may not use the Services for any unlawful purpose, to infringe intellectual property, to transmit malicious code, or to interfere with the Services.
  • If you submit reviews, photos, or other content ("User Content"), you grant EPIC a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content in connection with the Services and our marketing. You represent that you own or have rights to the content.

10. Intellectual Property

EPIC, EPIC Trail, "Bring The Ride Home," our logos, designs, and site content are protected by copyright, trademark, and other laws and are owned by or licensed to EPIC. You may not copy, reproduce, or create derivative works without our prior written consent.

11. DMCA Notice

If you believe content on our Services infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to dmca@epictrail.com.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, except where prohibited by law. You and EPIC each waive any right to a jury trial. Nothing in these Terms prevents you from bringing a small-claims action in your home jurisdiction where allowed.

13. Class-Action Waiver

You and EPIC agree to resolve disputes only on an individual basis and waive any right to participate in a class, collective, or representative action, to the fullest extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes means you accept the updated Terms.
